These Terms and Conditions constitute a legally binding agreement between you and ShivAi Labs Pvt Ltd. By creating an account or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using the ShivAi application, Lyana AI, or Cosmic Match (collectively the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Services.
These Terms constitute a legally binding agreement between you and ShivAi Labs Pvt Ltd. We reserve the right to modify these Terms at any time with 30 days' notice. Continued use after the effective date constitutes acceptance.
2. Eligibility
- You must be at least 18 years of age to use ShivAi and Cosmic Match
- You must be a resident of India or accessing the Services from a permitted jurisdiction
- You must have the legal capacity to enter into binding contracts
- You must not be prohibited from using the Services under any applicable law
3.1 ShivAi App
The ShivAi app provides AI-powered Vedic astrology guidance through Lyana, including birth chart generation, daily cosmic alignment scores, numerology readings, and personalised guidance in Shiva mode (clarity and direction) and Shakti mode (intuition and healing).
3.2 Lyana AI
Lyana is an artificial intelligence system trained on Vedic astrological principles. Her guidance is generated by AI and is intended for informational and entertainment purposes. Lyana's responses should not be relied upon as a substitute for professional advice — medical, legal, financial, or otherwise.
Important Disclaimer: Lyana's guidance is AI-generated and based on Vedic astrological tradition. ShivAi makes no warranty that Lyana's guidance is accurate, complete, or suitable for any specific purpose. Users should exercise their own judgment in making life decisions.
3.3 Cosmic Match
Cosmic Match is a Vedic matrimonial matching service that uses Lyana AI to provide Kundli-based compatibility analysis. Cosmic Match is a platform to facilitate introductions between consenting adults for the purpose of matrimony. ShivAi does not conduct background checks beyond face verification and is not responsible for the accuracy of user-provided information.
4. Account Registration
- You must provide accurate, complete, and current information when creating your account
- You are responsible for maintaining the confidentiality of your password and account
- You must notify us immediately of any unauthorised use of your account
- You may only create one account per person — multiple accounts may be suspended
- You must not create an account on behalf of another person without their consent
- ShivAi reserves the right to verify your identity and may suspend unverified accounts
5. Subscriptions and Payments
5.1 Pricing
ShivAi offers the following subscription plans:
- Free access — basic Kundli and daily alignment score
- Monthly subscription — Rs.300 per month
- Quarterly plan — Rs.799 per quarter (Rs.266/month effective)
- Annual plan — Rs.1,999 per year (Rs.167/month effective)
- Cosmic Match Premium — pricing as displayed in-app
5.2 Billing
Subscriptions are billed in advance. All prices are in Indian Rupees and inclusive of applicable taxes. Payment is processed via our authorised payment gateway partners.
5.3 Refund Policy
Subscriptions are non-refundable except where required by applicable law. If you experience a technical issue that prevents you from accessing the Services, please contact support@shivai.io within 7 days and we will review your case.
5.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through the app settings. Cancellation takes effect at the end of the current billing period.
6. User Conduct
By using our Services, you agree NOT to:
- Provide false, misleading, or inaccurate information in your profile or to Lyana
- Use the Services for any unlawful purpose or in violation of any applicable law
- Harass, abuse, threaten, or harm other users through Cosmic Match or any feature
- Create fake profiles or impersonate any person or entity
- Use automated tools, bots, or scripts to access or scrape the Services
- Attempt to reverse engineer, decompile, or extract the source code of the app
- Upload or transmit viruses, malware, or any harmful code
- Use the Services to solicit, advertise, or conduct any commercial activity not authorised by ShivAi
- Share your account credentials with any third party
- Post or transmit any content that is defamatory, obscene, pornographic, or offensive
Violation of these conduct rules may result in immediate suspension or permanent termination of your account without refund. ShivAi reserves the right to report illegal activity to law enforcement authorities.
7. Cosmic Match — Special Terms
In addition to the general terms above, the following specific terms apply to Cosmic Match:
- Cosmic Match is intended solely for matrimonial purposes — it is not a casual dating platform
- All profiles must be genuine representations of real individuals aged 18 and above
- Users must have genuine matrimonial intent to use the platform
- Profile information must be accurate including age, marital status, education, and profession
- ShivAi does not verify the accuracy of user-provided profile information beyond face verification
- Users are responsible for conducting their own due diligence before progressing any relationship
- ShivAi is not a marriage bureau and does not guarantee successful matches
- ShivAi's Vedic compatibility analysis is for guidance only and does not constitute a guarantee of compatibility
- Any physical meetings arranged through Cosmic Match are at the user's own risk and discretion
8. Intellectual Property
All content, features, and functionality of the ShivAi app — including but not limited to the Lyana AI system, ShivAi brand, Cosmic Match platform, all text, graphics, logos, and software — are the exclusive property of ShivAi Labs Pvt Ltd and are protected by Indian and international intellectual property laws.
- You may not copy, reproduce, distribute, or create derivative works from our content
- You may not use the ShivAi name, Lyana name, or any ShivAi branding without written permission
- Your birth chart data and personal content remain your property
- By using the Services, you grant ShivAi a limited licence to process your data to provide the Services
9. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHIVAI LABS PVT LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- The accuracy, completeness, or reliability of Lyana's astrological guidance
- The suitability or compatibility of any Cosmic Match introduction
- Uninterrupted or error-free operation of the Services
- That the Services will meet your specific requirements
Vedic astrology and numerology are ancient traditions with cultural and spiritual significance. ShivAi presents these traditions through AI technology. The guidance provided by Lyana is for informational and spiritual reflection purposes only and should not be relied upon as professional advice for any life decision.10. Limitation of Liability
To the maximum extent permitted by applicable law, ShivAi Labs Pvt Ltd shall not be liable for:
- Any indirect, incidental, special, or consequential damages arising from use of the Services
- Decisions made based on Lyana's guidance or Cosmic Match compatibility analysis
- Any harm arising from interactions with other users on Cosmic Match
- Loss of data, revenue, or profits arising from use or inability to use the Services
Our total liability to you for any claim arising from use of the Services shall not exceed the amount you paid to ShivAi in the 3 months preceding the claim.11. Termination
ShivAi reserves the right to suspend or terminate your account at any time for:
- Violation of these Terms or our Community Guidelines
- Fraudulent, illegal, or abusive activity
- Non-payment of applicable subscription fees
- At our sole discretion with 30 days' notice for any other reason
You may delete your account at any time through the app settings. Account deletion will result in deletion of your personal data in accordance with our Privacy Policy.12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation between the parties.
If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in New Delhi in the English language. You may delete your account at any time through the app settings. Account deletion will result in deletion of your personal data in accordance with our Privacy Policy.
Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction in New Delhi.
