1. Who We Are

ShivAi Labs Pvt Ltd ("ShivAi", "we", "us", or "our") is a company incorporated under the Companies Act 2013, with its registered office at A-19, Gr-Floor, Desk 215, FIEE Complex, Phase 2, Okhla Industrial Estate, South Delhi, New Delhi — 110020 (CIN: U62099DL2025PTC457957).


We operate the ShivAi mobile application, the Lyana AI cosmic guide, and the Cosmic Match matrimonial platform (collectively, the "Services"). We are the Data Fiduciary as defined under India's Digital Personal Data Protection Act, 2023 ("DPDPA").

2.1 Information You Provide

• Full name and date, time, and place of birth (required to generate your Vedic birth chart)
• Gender and preferred language
• Email address and mobile number (for account creation and OTP verification)
• Profile information for Cosmic Match — including photos, family background, education, profession, and preferences
• Any content you share with Lyana during conversations

2.2 Information Collected Automatically

• Device information — model, operating system, unique device identifiers
• IP address and approximate location (city level — not precise GPS unless you grant permission)
• App usage data — features accessed, time spent, interactions with Lyana
• Crash reports and performance data

2.3 Sensitive Personal Data

Birth chart data and astrological information may be considered sensitive personal data under applicable law. We collect and process this data solely to provide our Services and will not use it for any other purpose without your explicit consent.

2.4 Face Verification Data (Cosmic Match)

For Cosmic Match, we use AWS Rekognition to verify that profile photos are real. This is a one-time verification process. We do not store facial recognition data on our servers. Only the verification result (verified / not verified) is retained.

3. How We Use Your Data

• To create and manage your ShivAi account
• To generate your Vedic birth chart, numerology readings, and daily cosmic alignment scores
• To power Lyana AI — personalising her guidance based on your chart data
• To operate and improve Cosmic Match compatibility features
• To send you transactional communications — OTPs, account updates, booking confirmations
• To send you service notifications and updates (you may opt out of marketing messages at any time)
• To detect and prevent fraud, abuse, and security incidents
• To comply with legal obligations under Indian law
• To improve our products through anonymised, aggregated analytics

We will never sell your personal data to third parties. We will never use your birth chart or astrological data for advertising targeting. Your cosmic data belongs to you.

4. Legal Basis for Processing

We process your personal data on the following legal grounds under the Digital Personal Data Protection Act, 2023:

• Consent — for processing sensitive personal data including birth details and astrological information
• Contract — to provide the Services you have subscribed to
• Legitimate Interests — for fraud prevention, security, and service improvement
• Legal Obligation — where required by Indian law or court orders

5. Data Sharing

We share your data only with the following categories of recipients, and only to the extent necessary:

5.1 Service Providers

• Anthropic (Claude AI) — powers Lyana's conversational intelligence
• AWS (Amazon Web Services) — cloud infrastructure and face verification for Cosmic Match
• ElevenLabs — voice synthesis for Lyana's spoken guidance feature
• ClickAstro — Vedic calculation engine API for birth chart generation
• Analytics providers — for anonymised app performance data only

5.2 Legal Disclosures

We may disclose your data to law enforcement, government authorities, or courts where required by Indian law, a valid court order, or where we believe disclosure is necessary to protect our rights or the safety of users.

5.3 Business Transfers

In the event of a merger, acquisition, or sale of all or part of ShivAi Labs, your data may be transferred to the successor entity. We will notify you via the app or email before any such transfer.

6. Data Storage and Security

Your data is stored on secure AWS servers located in India and compliant regions. We implement the following security measures:

• End-to-end encryption for all data transmitted between your device and our servers
• AES-256 encryption for stored personal data
• Access controls — only authorised personnel can access user data, and only when required
• Regular security audits and penetration testing
• Two-factor authentication for all internal systems

7. Data Retention

We retain your personal data for as long as your account is active and for a reasonable period thereafter to comply with legal obligations.

• Account data — retained for the duration of your account plus 3 years after deletion
• Birth chart and astrological data — retained until you delete your account
• Conversation data with Lyana — retained for 12 months, then anonymised
• Face verification result (Cosmic Match) — retained until profile deletion

8. Your Rights

Under the Digital Personal Data Protection Act, 2023 and applicable Indian law, you have the following rights:

• Right to Access — request a copy of your personal data held by us
• Right to Correction — request correction of inaccurate personal data
• Right to Erasure — request deletion of your personal data (subject to legal retention requirements)
• Right to Withdraw Consent — withdraw consent for processing sensitive personal data at any time
• Right to Grievance Redressal — raise a complaint with our Grievance Officer
• Right to Nominate — nominate a person to exercise your data rights in case of death or incapacity

9. Children's Privacy

The ShivAi app and Cosmic Match are not intended for persons under the age of 18. We do not knowingly collect personal data from minors. If you believe a minor has created an account, please contact us at privacy@shivai.io and we will delete the account immediately.

10. Cookies and Tracking

The ShivAi app uses limited tracking technologies for the following purposes:

• Session management — to keep you logged in
• Analytics — anonymised, aggregated data to understand app usage
• Crash reporting — to identify and fix technical issues

11. Third-Party Links

The ShivAi app may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to read the privacy policies of any third-party services you access through our app.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes via the app or email at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated policy.

13. Governing Law

This Privacy Policy is governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi.
